Website terms and conditions

This document sets out the terms under which you use the Loyo Rewards website at www.loyorewards.com.

The website is owned and operated by LOYO REWARDS LIMITED ("Loyo Rewards"), a private limited company incorporated in Kenya with its registered office at Westlands, Nairobi, Kenya. Loyo Rewards may change these Terms and Conditions at any time and will post the updated version on this website with a new date.

Definitions

By accessing or using the Website, you (the Visitor) acknowledge and agree to the following terms.

1.0 Fair and Responsible Use

1.1 The Website is provided to share information about the Platform and to let Visitors make Enquiries. It may be used for personal or internal business purposes only, and may not be used for any other commercial purpose without the written consent of Loyo Rewards.

1.2 Visitors must give accurate and current contact details when they make an inquiry.

1.3 Any login details or PINs for the Platform must be kept confidential, and any unauthorised use must be reported to Loyo Rewards promptly. The Platform is governed by its own terms (see clause 3.6).

1.4 Visitors must not interfere with or attempt to gain unauthorised access to the Website, the Platform or any related systems or data, or introduce viruses or other harmful code.

1.5 Visitors must not use the Website for anything illegal, give false or misleading information, or misuse the Platform, including any fraud aimed at obtaining rewards or vouchers dishonestly.

1.6 Abusive, harassing or offensive communications towards Loyo Rewards staff, Merchants or Customers are not allowed.

1.7 Visitors must not copy, scrape or collect data from the Website by automated means, or reverse-engineer or modify any part of the Website or Platform.

1.8 If these rules are broken, Loyo Rewards may restrict or block access to the Website and, where appropriate, take legal action.

2.0 Offers, Information and Right to Change

2.1 The Website gives general information about the Platform. Descriptions of features, example programs, demonstration videos, prices and results are for illustration only and do not promise any particular business outcome.

2.2 Merchants set their own loyalty offers, rewards and conditions, and may change them. Loyo Rewards provides the technology only and is not a party to a Merchant's offer to its Customers.

2.3 Loyo Rewards may change the Website, its services, its published prices and these Terms at any time. Updated Terms apply from the date they are posted. If you keep using the Website after that date, you accept the update.

2.4 If Loyo Rewards believes these Terms have been broken, it may restrict or block a Visitor's access. Where practical, it will tell the Visitor why.

3.0 Information About You

3.1 When you make an inquiry we ask for your name and business name, your phone or WhatsApp number, and optionally your email address and type of business. We use this to reply to you and to arrange a walkthrough, as set out in our Privacy Policy.

3.2 Loyo Rewards handles personal information in line with the Data Protection Act, 2019 of Kenya. You have rights over your information, including to see it, correct it and ask for it to be deleted. Please see our Privacy Policy for how to use them.

3.3 We do not sell your personal information. We share it only with service providers who help us run the Website and Platform, and where the law requires. We send marketing messages only with your permission, and you can opt out at any time.

3.4 The Website is not a social network. Visitors cannot see or contact each other through it.

3.5 The Website uses cookies and similar tools to work properly and to understand how it is used. You can control cookies in your browser settings.

3.6 If you use the Platform, other terms also apply: the Merchant Terms and Conditions for the individual businesses, the Gift Voucher Terms for gift vouchers. For the Platform itself, those documents apply if they differ from these Terms.

4.0 Intellectual Property

4.1 All Content on the Website that comes from Loyo Rewards, including the Loyo Rewards name, logo, designs, text, videos and software, belongs to Loyo Rewards or its licensors and is protected by law.

4.2 You may view the Website and share its pages for your own personal or internal business use. You must not copy, change, sell or republish its Content without the written permission of Loyo Rewards.

4.3 Merchant names and logos shown on the Website are shown with permission and belong to those Merchants.

5.0 Limitation of Liability

5.1 You use the Website at your own risk. The information on it is general and is not legal, financial or professional advice.

5.2 The Website is provided "as is" and "as available". Loyo Rewards does not promise that it will be error-free, secure or available at all times.

5.3 To the fullest extent permitted by law, Loyo Rewards is not liable for indirect, incidental or consequential loss, including loss of opportunity, profits or data, arising from your use of the Website or from relying on its Content. This applies whatever the cause, including mistakes, technical problems, viruses, or events outside our reasonable control.

5.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Kenyan law.

5.5 The Website may link to other websites, including the Platform and third-party sites. Loyo Rewards does not control third-party sites and is not responsible for their content or practices.

6.0 Applicable Law and Dispute Resolution

6.1 These Terms are governed by the laws of Kenya.

6.2 If a dispute arises about these Terms or the Website, please first contact Loyo Rewards so we can try to resolve it informally. If it is not resolved within 60-90 days, the parties will try mediation in Nairobi, sharing the cost equally unless they agree otherwise. If mediation does not resolve the dispute, either party may take it to the courts of Kenya.

7.0 Miscellaneous

7.1 If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms continue to apply.

7.2 Loyo Rewards may transfer its rights and obligations under these Terms to a successor to its business. A Visitor may not transfer theirs without the written consent of Loyo Rewards.

7.3 These Terms, together with the documents mentioned in clause 3.6 where they apply, are the whole agreement between you and Loyo Rewards about your use of the Website.
